These Terms of Service ("Terms") govern your access to and use of BRANE, including our website, image-generation tools, credit purchases, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
BRANE uses artificial intelligence to analyze submitted hairstyle inspiration and create visualizations from a selfie and selected hairstyle and color references. Analyses describe only what is visible and may be affected by lighting, filters, image quality, and hidden angles. Color suggestions and generated results are simulations, may contain errors or artifacts, and may not predict how a haircut, color, or treatment will look in person. The Service is for visualization and entertainment and is not professional salon, medical, or other professional advice.
Some features require an account. You must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity conducted through your account. BRANE may make introductory or promotional credit offers available to eligible accounts. The offer shown to you controls its credit amount, purchase requirement, and claim deadline. Each campaign is limited to one redemption per eligible account, and attempts to obtain duplicate grants through abuse or fraud may result in suspension or termination.
BRANE uses virtual credits. One credit permits one hairstyle generation or one paid inspiration analysis, as shown before you confirm the action. A completed inspiration analysis may be reused without another analysis credit, while creating a preview uses a generation credit. Credits are licensed for use only within the Service, have no cash value, are not transferable, and cannot be redeemed for money or used outside BRANE. Credits do not expire while your account remains open, but unused credits are forfeited when your account is deleted.
Available packs, prices, taxes, and currencies are shown at checkout. Prices may be localized and may change for future purchases. RevenueCat manages offerings and credit balances. Stripe processes eligible web payments and may act as merchant of record through Stripe Managed Payments; Stripe Link may provide checkout, order-history, and payment support features. Your payment is also subject to the applicable provider's terms.
Credit-pack purchases are final except where a refund or other remedy is required by law, payment-network rules, or provider policy. BRANE does not offer a voluntary in-app refund program. If Stripe, RevenueCat, a payment network, or another authorized provider issues a refund, reversal, or dispute adjustment, the associated credits may be removed from your available balance. Credit revocation stops at zero; BRANE does not create a negative credit balance for credits already spent. When a generation fails after a credit has been charged, BRANE will return that credit after the failure is confirmed, subject to safeguards against duplicate adjustments. The same automatic credit-restoration safeguards apply when a paid inspiration analysis fails or cannot produce an actionable result.
A promotional claim may expire at the deadline shown in the offer. Credits already granted through a valid claim do not expire while your account remains open. A purchase-linked bonus is added only after the qualifying payment is fulfilled. If that payment is refunded, reversed, or disputed, BRANE may remove unused bonus credits without reducing your balance below zero.
You retain your rights in selfies, inspiration images, and other content you submit. You grant BRANE and its service providers a limited, non-exclusive license to host, copy, process, modify, and display that content only as necessary to provide your requested analysis or generation, maintain the storage and history features you use, secure the Service, and carry out sharing choices you make.
Generations are private by default. If you affirmatively make a generation public, you grant BRANE a worldwide, non-exclusive, royalty-free license to reproduce, display, distribute, adapt, and use that generation to showcase and promote the Service. You will not receive compensation for that use. You may later make the generation private, but copies already included in published, cached, archived, or physical materials may remain.
You represent that you have all rights and permissions needed for content you submit, including third-party inspiration screenshots and the consent of any person depicted. You remain responsible for your content and for how you use or share generated images.
During first-look onboarding, BRANE may temporarily stage your hairstyle inspiration and selfie before you create or sign in to an account so that account creation does not require selecting the photos again. Unclaimed staged photos expire after one hour and are then deleted from active systems, although restricted backup copies may remain until routine backup rotation. Once you sign in, the staged photos may be attached to your account and follow the account-based retention rules below. A raw upload interrupted before attachment to a guest draft is removed by routine orphan cleanup within 24 hours. Incomplete analysis and generation drafts expire after 24 hours. Draft-owned selfies and inspiration images are then deleted from active systems, although restricted backup copies may remain until routine backup rotation. Failed attempts may remain in History with a safe failure status, but generation-owned photos and partial output media are deleted from active systems after 24 hours. This cleanup does not delete a shared default selfie. Completed analyses remain reusable with their source images until you delete the analysis or your account, except that media still referenced by a generation remains with that generation. Completed generations and their associated media remain available until you delete the generation or your account. A photo selected as your reusable default selfie is shared account storage; deleting an individual generation does not delete that default photo. You may delete the default photo separately or delete your account. Account deletion removes BRANE-controlled account data and owned media through our deletion process, subject to short operational delays and records that BRANE or its providers must retain for legal, security, fraud, accounting, dispute, or payment-processing obligations.
We may send service-related emails and in-app notifications about generations, credit purchases or adjustments, security, support, and material Service changes. We use Knock to coordinate these notifications and Resend to deliver certain emails. Transactional communications are part of operating your account and are not marketing messages. Optional marketing messages, including hairstyle education and time-limited credit offers, are sent only when your marketing email preference permits them. You may turn those messages off in Settings, use the preference link, or unsubscribe from any marketing email. Unsubscribing from marketing does not disable service-related communications.
You may not:
We may update, suspend, or discontinue features, models, credit packs, or the Service. We do not guarantee that the Service will always be available, uninterrupted, or error-free. We may temporarily limit generation capacity while work is queued or providers are unavailable.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." BRANE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM THE SERVICE. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.
You may stop using the Service or delete your account at any time. We may suspend or terminate access when reasonably necessary to protect users, providers, BRANE, or the Service; investigate suspected fraud or abuse; comply with law; or enforce these Terms. Provisions that by their nature should survive termination will survive, including ownership, licenses already exercised, disclaimers, liability limits, and payment-related obligations.
We may revise these Terms by posting an updated version and changing the "Last updated" date. If a change materially affects your rights, we will provide notice as required by law. Your continued use after the effective date of revised Terms constitutes acceptance where permitted by law.
